Terms of Use
These Terms of Use of the website www.barka.pro (hereinafter, the “Website”), developed by Barka LLC (hereinafter, the “Terms”), establish the conditions for using the Website and set out the rights and obligations of visitors of the Website (hereinafter collectively, the “Users”).
1. Definitions
Website — a collection of web pages hosted on the Internet under the domain name barka.pro, unified by a common theme, logical structure, design, and layout.
Content — all results of intellectual activity and means of individualization displayed on the Website, including design elements, projects, drawings, mock-ups, graphic images (including illustrations), photographic works and works created in ways similar to photography, text, audiovisual works, software forming part of the Website, musical works with or without lyrics, and other works, as well as trademarks and industrial designs. Such Content is protected under the legislation of the Russian Federation, including international treaties to which the Russian Federation is a party.
Personal Data — any information relating directly or indirectly to an identified or identifiable natural person (data subject), including personal information provided by the User through feedback forms or when placing an order on the Website.
www.barka.pro — Barka LLC, owner of the Website and/or persons authorized by the Owner to manage and/or otherwise operate the Website, as well as the company providing sales of goods and services displayed on the Website.
User — any person accessing the Website.
Results of Intellectual Activity / Works — results of intellectual activity and/or means of individualization protected under the legislation of the Russian Federation, created through the creative work of one or more individuals. All rights to materials displayed on the Website are protected under Russian law, including Part IV of the Civil Code of the Russian Federation. Copying Website materials is allowed only with written permission from Barka LLC.
User’s Personal Page (if applicable) — a section of the Website containing personal data, information, groups, friends, or other User-related details.
Rightsholder — a person holding exclusive rights to the Results of Intellectual Activity or a person holding an exclusive license to use such Results.
2. General Provisions
2.1. The Website was developed and is owned by Barka LLC (a legal entity established under the laws of the Russian Federation and registered at: 143200, Moscow Region, Mozhaisk, Pereyaslav-Khmelnitsky St., 15, premises 1, TIN 5028035034). The Website is dedicated to the sale of goods and the provision of services in the fields of architecture and construction. These Terms are governed by the legislation of the Russian Federation and apply within its territory. The Website does not constitute a public offer. Prices displayed on the Website are for informational purposes only and may be changed.
2.2. These Terms regulate the relationship between Barka LLC and the User regarding use of the Website.
2.3. By using the Website, the User confirms that they have read and accept these Terms.
2.4. Barka LLC recommends that Users review these Terms as well as the Privacy Policy. By using the Website, Users confirm their agreement with these Terms and the Privacy Policy.
3. Intellectual Property Rights
3.1. All results of intellectual activity and means of individualization displayed on the Website, including design elements, projects, drawings, mock-ups, graphic images (including illustrations), photographic works, text, audiovisual works, software, musical works, and other works, as well as trademarks and industrial designs, are protected under the legislation of the Russian Federation and relevant international treaties. Collectively and individually, these items constitute the protected Content of the Website.
3.2. Barka LLC is the rights holder of the Website as a compilation, as well as the rights holder of the Content (unless otherwise indicated for specific Content).
3.3. Except as expressly provided in these Terms or by applicable law, the Content may not be used (including copied, published, reproduced, modified, distributed, sold, or used otherwise) in whole or in part without written consent from Barka LLC.
3.4. Quotation of text materials published on the Website is permitted only with an active hyperlink to www.barka.pro or the specific Content page.
4. Personal Data
General Provisions
4.1. To use feedback forms or place orders through the Website, Users must provide Personal Data.
4.2. Barka LLC takes necessary measures to protect Personal Data from loss, misuse, unauthorized access, disclosure, alteration, or destruction. The processing of Personal Data is carried out in accordance with Federal Law No. 152-FZ “On Personal Data” and other applicable legislation, as well as the Privacy Policy of Barka LLC.
4.3. Personal Data provided by Users via feedback forms and order forms is stored on the Yandex.ru mail server. Unless otherwise indicated by the User, such Personal Data may be used by Barka LLC to contact the User for informing about promotions, offers, events, and related information.
4.4. Personal Data will not be transferred to third parties except when required by law. A User may request information about their Personal Data processed by Barka LLC and request corrections or deletion. Third parties supporting the Website or fulfilling tasks on behalf of Barka LLC may have access only to the extent necessary.
4.5. Users may contact Barka LLC regarding Personal Data at the addresses and numbers specified in Section 8.3.
4.6. Barka LLC takes measures to prevent unauthorized access to Personal Data transmitted through Website forms.
4.7. Barka LLC is not responsible for the actions of third parties (including Internet providers) regarding communication channels used to transmit information to or from the Website, nor guarantees uninterrupted Website availability.
4.8. Unless otherwise stated, Barka LLC may use information collected via the Website to improve the Website, adapt it to User preferences, communicate with Users (on request), conduct marketing research, and for other lawful purposes. Non-identifiable information may be used without restriction.
5. Third-Party Websites
5.1. The Website may contain links to third-party websites. Barka LLC does not control such websites and is not responsible for their content. These Terms do not apply to third-party websites. Users should review the privacy policies and terms of each such website.
6. Users’ Rights and Obligations
6.1. Users have the right to submit complaints to Barka LLC regarding Website Content or functionality.
6.2. Users must:
— comply with applicable legislation and these Terms;
— provide accurate and up-to-date data when using Website forms;
— compensate damages arising from breach of these Terms or law;
— review all legal information available on the Website;
— regularly check announcements regarding amendments to the Terms;
— discontinue use if disagreeing with the Terms.
6.3. Users are prohibited from publishing or distributing information that:
— contains threats, insults, defamatory statements, or violates privacy;
— violates rights of minors;
— is obscene or pornographic;
— depicts violence or cruelty;
— promotes suicide;
— incites racial, religious, or ethnic hatred;
— contains extremist materials;
— promotes criminal activity;
— contains restricted information (state or commercial secrets, personal data of third parties);
— promotes drug use;
— is fraudulent;
— violates intellectual property rights or personal data rights;
— violates other rights under Russian law.
6.4. Users are prohibited from:
— sending mass unsolicited messages;
— using software to disrupt Website operation;
— distributing malware;
— posting commercial or political advertisements;
— performing actions that may harm the Website or its Users.
7. Rights and Obligations of Barka LLC
7.1. Barka LLC provides Users with technical access to the Website.
7.2. Barka LLC is entitled to process Users’ Personal Data.

8. Amendments
8.1. Barka LLC may unilaterally amend these Terms. Amendments become effective after publication on www.barka.pro and, where applicable, in other official sources. Amendments apply to all Users, including existing ones, and take effect 30 days after publication.
